Ex-Chief Justice Questions Mwengi Mutuse’s Law Degree After Gachagua’s Ouster.
On Saturday, October 19, Kibwezi West MP Mwengi Mutuse found himself once again under heavy scrutiny, despite his recent success in the impeachment motion against the ousted Deputy President Rigathi Gachagua.
This time, former Chief Justice Willy Mutunga led the charge, suggesting that Mutuse’s degree should be revoked. Mutunga’s remark was prompted by a satirical cartoon published in a local newspaper.
The cartoon depicted how Mutuse was thoroughly challenged by Elisha Ongoya, a member of Gachagua’s legal team.
The commentary highlighted how Ongoya exposed Mutuse’s weaknesses, stating that Mutuse, basking in his newfound fame, was quickly reduced to confusion when confronted by Ongoya.

Mutunga responded with a sharp comment, implying that Mutuse’s law degree and Kenya School of Law diploma should be recalled.
“Do you have a dog in this circus, comrade? I doubt. The Mutuse comment is apt. They should recall Mutuse’s law degree and KSL diploma.”
Mutuse’s Impeachment Motion
Mutuse had brought forward an impeachment motion against Gachagua in early October, based on 11 serious allegations.
However, on Wednesday, October 16, the lawmaker faced a tough cross-examination by Gachagua’s legal team, particularly Ongoya, who discredited the claims with precision, leaving Mutuse visibly shaken.
At times, Mutuse’s answers during the cross-examination were short and unconvincing, especially when questioned about the allegations regarding the Vipingo Beach Resort, a key asset in the impeachment case.
On Thursday, Mutuse managed to regain composure and provided more convincing responses to some of the unresolved issues.
Ultimately, despite the challenges, Mutuse prevailed when Gachagua was impeached, marking a significant moment as this was the first impeachment since the 2010 Constitution was enacted.
Aftermath of Gachagua’s Impeachment
Following Gachagua’s impeachment, the ripple effects were felt immediately. Over 108 members of his office were directed to take compulsory leave.
The High Court, led by Justice Chacha Mwita, quickly responded to an application filed by Senior Counsel Paul Muite, Gachagua’s advocate, suspending the appointment of a new Deputy President.

This ruling halted any replacements for Gachagua until at least October 24.
Meanwhile, President William Ruto nominated Gachagua’s rival, Kithure Kindiki, as the new Deputy President, and the National Assembly approved the appointment.
