High Court Halts New University Funding Model.
The Ruto administration’s efforts to enhance education quality have faced a significant setback as the High Court suspended the implementation of the new University funding model.
On October 3, 2024, Justice Chacha Mwita ruled to temporarily halt the model, awaiting the hearing and determination of a case brought forward by the Kenya Human Rights Commission (KHRC) last year.
Justice Mwita pointed out that the case had been pending for an extended period due to delays by the Attorney General, Education CS, and the Kenya Universities and Colleges Central Placement Service (KUCCPS) in filing their submissions.
The KHRC, alongside the Elimu Bora Working Group, Boaz Waruku, and the Students Caucus, had filed the case on October 13, 2024, challenging the model.
Case Details and Hearing Date
According to the plaintiffs, the model would exclude thousands of students from receiving financial aid. The case is set to be heard on December 16, 2024, where submissions from all parties will be presented.

The university funding model has been a subject of debate since its introduction, with critics questioning its effectiveness.
The model categorizes students into five financial bands based on their needs, using a Means Testing Instrument (MTI). This tool assesses each student’s financial situation by considering factors like family background and monthly income.
Critics argue that the new model may not adequately address issues within the education system.

Some have suggested that the government should have focused on improving the existing funding structure rather than introducing a new one, which they believe creates additional challenges for students.
