KUPPET Issues Directive on TSC’s Unlawful Dismissal of 700 JSS Teachers
The Kenya Union of Post Primary Education Teachers (KUPPET) has expressed serious concern regarding the recent dismissal of approximately 700 Junior Secondary School (JSS) teachers.
KUPPET says the dismissal contradicts the Return-to-Work Formula (RTWF) negotiated by KUPPET with the Teachers Service Commission (TSC).
The RTWF, agreed upon to end the recent labour action, stipulated that:
- All teachers would resume work on June 3, 2024, without facing disciplinary action for their participation in the legitimate strike.
- All previously issued show-cause letters and dismissal notices would be revoked for those who resumed duty, ensuring normalcy in JSS institutions.
Despite these conditions, reports indicate that over 700 teachers who complied with the RTWF were still dismissed.
These teachers either returned to their schools or attended the mandated ‘retooling’ centres, and should not have faced any disciplinary actions according to the union.
“Teachers who resumed work on 3 June 2024 either at their respective schools or at the ‘retooling’ centres had no disciplinary issues ensuing. This is irrespective of whether they replied to show-case letters or not.”
KUPPET’s Secretary General has instructed all KUPPET Branch Executive Secretaries to gather information from affected teachers.

Evidence of resumption of work on June 3, 2024, should be submitted by the close of business on Friday, June 14, 2024.
Additionally, a separate list of teachers who resumed work after June 3, 2024, is to be compiled for further intervention with the TSC.
