KUSO Petitions High Court for Urgent Release of HELB Funds to Students Under New Funding Model.
The Kenya Universities Students Organization (KUSO), under the leadership of President Antony Manyara, has submitted an urgent petition to the High Court of Kenya, requesting the immediate release of Higher Education Loans Board (HELB) funds for students under the recently introduced Higher Education Funding Model (HEFM).
This appeal is directed at Hon. Justice Chacha Mwita in the Constitutional Division, referencing Case No. HCCHRPET/E412/2023.
Following a court order issued on October 3, 2024, HELB funding has been restricted to students under the old funding system.
This restriction has left thousands of students, who enrolled under the new funding model, without the financial support they urgently need. As a result, many are struggling to cover basic expenses such as tuition, rent, and daily sustenance.

KUSO’s petition highlights the critical situation facing these students, who are unable to afford even minimal educational expenses due to the withheld funds.
HELB has stated that it will delay further disbursements until a court decision expected on December 16, 2024.
However, KUSO argues that this wait is unsustainable and poses severe risks to students’ academic progress, mental health, and financial stability.
KUSO’s Appeal
With the approval to join the case as an interested party, KUSO is pressing the court to act swiftly in authorizing HELB to release funds to students under the new funding model.
The organization’s petition emphasizes the rights to education enshrined in Articles 43 and 53 of the Kenyan Constitution, as well as the state’s duty to protect its most vulnerable citizens.
President Antony Manyara expressed KUSO’s concern that delaying these funds until mid-December will continue to disrupt students’ lives and studies.
The organization calls on the court to intervene compassionately and promptly to ensure students receive the support they need.
