Teacher Who Whipped Pupil 107 Times Sentenced to 3 Years in Prison.

A teacher at Riang’ombe SDA Primary Boarding School in Nyamira County has been sentenced to three years in prison or a fine of Ksh. 300,000 after being found guilty of assaulting a 9-year-old student by caning him 107 times.

The incident occurred on March 26, 2023, when teacher Jackson Mobisa Marucha punished the student, Titus Ondari, for allegedly misplacing his school uniform. Following the assault, Marucha went into hiding for three days.

Investigating officers, Constable Robert Mutua and Sergeant Danson Murithi, initially filed assault charges against him.

“The accused is hereby sentenced to a fine of Ksh300,000, in default, three years imprisonment; the right of appeal is 14 days,” the Magistrate asserted.

Legal Proceedings

Keroka High Court Magistrate Eunice Nyuthu ruled on the case, finding insufficient evidence to support the charge of attempted murder. As a result, the 29-year-old teacher was acquitted of that charge but convicted of assault.

The Office of the Director of Public Prosecutions (ODPP) had earlier elevated the charges from assault to attempted murder following further investigations.

Outside the Nyamira law courts, the family of the victim expressed dissatisfaction with the ruling. They stated their intent to appeal, feeling that the sentence did not reflect the severity of the incident.
