Accused Individuals and Charges
Three individuals were arraigned in court over the KPSEA examination debacle at Silver Bells Academy, Eldoret, where 23 pupils missed the exams.
Those charged included the school director, Margret Indaasi, the head teacher, Donald Lumwaji, and a third individual, Allan Kenyatta.
Indaasi and Lumwaji were accused of unauthorized possession of examination materials. Prosecutors stated that on October 30, 2024, at Silver Bells Junior Academy, they were found in possession of KPSEA-branded Mathematics, Integrated Science, and English Language exam papers linked to the 2023 KPSEA.
Indaasi faced an additional charge of running an unregistered private school. She was accused of operating Silver Bells Junior Academy without registration from the Ministry of Education on the same date.

Lumwaji was also charged with falsely presenting himself as a registered teacher while serving as head teacher without a TSC number or the requisite qualifications under the teachers’ regulations.
Kenyatta’s Charges
Kenyatta, the third accused, faced eight counts, including impersonating a director of education from the Ministry of Education.
He was also accused of forging stamps from the Uasin Gishu County NEMA director and Moiben Sub-County director of education.
Additionally, Kenyatta allegedly uttered unauthorized KPSEA exam papers prepared by KNEC and is linked to fraudulent registration of the unregistered private school where the pupils missed the exams.
During their court appearance before Senior Resident Magistrate Rodgers Otieno, all three denied the charges.

The court granted Indaasi and Lumwaji bonds of Sh300,000 each or cash bails of Sh150,000. Kenyatta was released on a bond of Sh500,000 or a cash bail of Sh150,000.
The scandal led to the closure of Silver Bells Junior Academy, which had a student population exceeding 300. The court session was attended by numerous parents affected by the school’s abrupt shutdown.
The magistrate set the case for mention on December 2, 2024, for further directions.
