TSC and KNUT Set for Recognition Agreement (RA) Review.

The Teachers Service Commission (TSC) is scheduled to engage with the Kenya National Union of Teachers (KNUT) next week in Naivasha to address contentious clauses in their 2021 Recognition Agreement (RA).

The discussions will take place from November 18 to November 22, 2024, as confirmed by KNUT’s First National Vice Chairman, Malel Lang’at.

Purpose of the Meeting

The primary focus of the meeting will be the amendment of the TSC/KNUT Recognition Agreement.

Malel noted that the 2021 RA, which replaced the 1968 version, was signed under duress and contains several clauses that negatively affect stakeholders. Among the key issues to be reviewed are:

  1. Reduction of Branches: Clause 6 mandates reducing KNUT branch executive secretaries from 110 to 47 by July 1, 2026.
  2. Membership of Institutional Administrators: Clause 7 bars institutional administrators, such as headteachers, from union membership.
  3. Other Concerns: Issues related to branch demarcation, unionized heads of institutions, and constitutional rights and privileges overlooked in the RA.

Malel emphasized that these clauses contravene the Labour Relations Act and relevant laws, necessitating urgent amendments.

The union officially wrote to TSC requesting the review, providing a one-month notice to justify the amendments.

Malel, speaking during a fundraiser in Shakoee village, Transmara, for Rift Valley Region KNUT Chairman John Musere, underscored the need for a collaborative effort. The event raised Ksh4.4 million to clear a hospital bill.

The Amendment Process

TSC and KNUT are expected to form a sub-committee comprising joint chairpersons from both parties. This team will assess the proposed amendments and present their findings and recommendations.

Once a consensus is reached, the agreed changes will be registered with the Registrar of Trade Unions for implementation.

This collaborative process aims to ensure the RA aligns with constitutional provisions and supports stakeholders across the education sector.
