TSC Exit from Service Methods and Their Implications

Here are the methods by which TSC teachers can leave service, as well as their implications:

1. Early Retirement

TSC Teachers can request for retirement at the age of 50 and after completing 10 years of continuous service on permanent and pensionable terms.

The Commission considers the application and issues a retirement notice. Medical grounds for retirement can be negotiated with the Director of Medical Services.

Teachers may retire in the public interest based on their usefulness to the profession or other public assignments. Eligible teachers receive a lump sum and a monthly pension upon retirement..

2. TSC Resignation.

A teacher on permanent and pensionable terms may resign after three months’ written notice or by paying one month’s basic salary in lieu of notice. Resignation will not result in any pension benefits.

However, a male teacher who resigns or faces termination is eligible for WCPS reimbursement. This teacher should ask for a refund.

Resignation on Marriage Grounds

A married female teacher who has taught for at least five (5) years on P&P terms may quit due to marriage.

A marriage gratuity is payable at the rate of 1/12 of a month’s pensionable emoluments for each completed month of pensionable service, up to a maximum of one year’s pensionable earnings.

3. Termination of Service

Either the Commission or the teacher may terminate a teacher’s appointment, whether on temporary or probationary terms, by providing one month’s written notice or by paying one month’s basic salary.

The Commission or the teacher may cancel an appointment on P&P terms by providing three (3) months’ written notice or paying one (1) month’s basic salary in lieu of notice.
NSSF Act Cap. 258 governs the handling of NSSF benefits in the event of a temporary assignment. 258.

A male instructor who contributed to WCPS is eligible for reimbursement of the sums contributed.

4. Death

If a teacher dies while on permanent and pensionable terms and was confirmed in the service, their dependents are entitled to a Death Gratuity and Dependants Pension.
The following rules will apply for the payment of the death gratuity:

  • The deceased teacher’s name is removed from the payroll, and any overpayments are reported.
  • The next of kin should submit the original death certificate as well as a letter from the area chief identifying the next of kin and dependents.
  • The next of kin will settle any outstanding payments.
  • The claim is submitted to the Director of Pensions for payment. If a dispute arises, the Deputy County Commissioner will direct the parties for arbitration.
  • The dependents may also ask a court of law for legal redress.
  • Pensions are granted to dead dependents under the age of 18 for a period of five years.

Killed while on duty.

This is the pension paid to dependants when a teacher is killed while on duty.
The benefit is payable to the spouse and/or dependants of a teacher who dies as a result of injuries sustained while on duty and without his or her own purpose.

NB: Retirees and/or next of kin are notified when claims are forwarded to the Treasury for payment.

5. Release to other organizations.

A teacher who has been appointed to a Public Institution, Teachers Union, non-profit making educational institution, or Parastatal should submit a written application to the Commission through the head of the institution or agent and:

  • Please attach a copy of the appointment letter.
  • Present the letter of acceptance of the offer.
  • To be released, present a TSC clearance certificate from the institution’s head or the TSC County Director.

Benefits from the teaching service are postponed until the retiree receives benefits from the institution to which he or she was discharged.

6. Transfer of Service

A teacher who is offered work by the Public Service Commission will have his or her previous service transferred to the new ministry.

Such a teacher must apply for transfer of service, submitting the appointment letter, acceptance of offer letter, and TSC clearance certificate.

  • The Commission will process the Transfer of Service paperwork.
  • Submit documentation to the appropriate government or department.

7. Compulsory Retirement

This applies to teachers above the age of 60. A notice will be issued two years before the retirement date.

In some instances, the Commission may give a shorter retirement notice.
Upon receiving a retirement notification, teachers must promptly transmit all appropriate documentation.
