TSC Responds to Unauthorized Female Teachers Payslip Deductions

The Teachers Service Commission (TSC) has responded to a legal dispute with female teachers (KEWOTA) regarding the purported unauthorized deduction of welfare fees totaling hundreds of millions of shillings from their pay stubs over the past five years.

According to TSC, the petition by the female teachers is based on misrepresentation of facts, employment law, and practice.

Evaleen Mitei, the acting TSC director in charge of Human Resource Management, stated that through the T-Pay system, teachers can discontinue or stop any unauthorized deductions.

“Through the T-Pay system, teachers have the absolute ability to discontinue or stop any deductions that are unauthorized,” says Ms. Evaleen.

She described the allegations in the petition as illogical and untenable.

Ms. Mitei also noted that SWA deductions were made on behalf of the Kenya Women Teachers Association (Kewota), a union that one of the petitioners, Ogola, has allegedly belonged to since 2019, a claim Ogola denies.

“Accordingly, the allegations in the petition against the commission are not only illogical but also untenable under the circumstances.”

Documents submitted to the Employment and Labour Relations Court in Nakuru reveal that the sh200 monthly deductions designated as Social Welfare Association (SWA) on the teachers’ pay stubs do not reflect the receiving organization.

The teachers ask the court to rule that the forcible enrollment in an unidentified entity and the deduction of funds from their wages have subjected the female teachers to financial embarrassment and injustices.

Knut has not yet replied to the petition, which has significant financial implications for the unions and teachers’ welfare associations.

As a result of the petition, TSC has stopped Burial and Benevolent Fund (BBF) deductions in favor of Kuppet, as indicated in a memo to Akello Misori, the union’s secretary-general.
