TSC Internship Policy is Illegal, Court Rules
The court’s ruling adds to the number of issues plaguing the internship program, including strong opposition to its extension.
The internship program was originally scheduled to last one year before the interns were hired on a permanent and pensionable basis.
However, President William Ruto announced in December that the teachers would have to serve an extra year before they could be considered for permanent and pensionable employment.
The court heard that TSC had given the interns contracts to teach two subjects. However, in class, they covered everything, including science and math.
At the same time, individuals hired complained that certain colleagues were hired on permanent and pensionable conditions while others were retained on the terms of college and university professors placed in schools to learn how to teach.
There were allegations that despite the tutors receiving an ‘intern stipend’, TSC deducted all government taxes and levies, including the contentious housing charge.
The Forum for Good Governance and Human Rights filed the action on the interns’ behalf. This implied that the hiring process lacked oversight, leaving individuals to handle all issues independently.

“The second respondent is handling the lives and rights of the children casually as test guinea pigs to confirm whether the CBC can work. I state that this is indeed a worrying state,” the court heard.
One of the affected teachers provided an affidavit in support of the case. Oroso Oganga clarified his assignment to Eking Narok Primary School in Kajiado County.
His degree claimed that he had earned a Bachelor of Education (Arts). His contract with TSC stated that he would teach history or Christian religious instruction.

He also stated that he was in charge of the class’s administration and management. Oroso stated that despite his efforts, he received a Sh20,000 stipend.
