    TSC Removes 7 Teachers From Register After Disciplinary Process.

    The Teachers Service Commission (TSC) has removed seven teachers from the Register of Teachers following the conclusion of disciplinary proceedings conducted during the 2024/2025 and 2025/2026 periods.

    The deregistration was published in a Gazette Notice dated July 10, 2026, in accordance with the Teachers Service Commission Act, Cap. 212 of the Laws of Kenya, which provides the legal framework governing the registration, employment, remuneration, discipline, and regulation of teachers in Kenya.

    According to the Gazette Notice, all seven teachers were removed from the Register of Teachers on February 25, 2026, after undergoing the Commission’s disciplinary process. The notice did not disclose the specific allegations, offences, or circumstances that resulted in the disciplinary action.

    The Teachers Service Commission stated:

    “In exercise of the powers conferred by Section 30(1)(e) of the Teachers Service Commission Act, Cap. 212 of the Laws of Kenya, the Commission wishes to notify the public that the persons whose names are specified in the schedule below have been removed from the Register of Teachers pursuant to the provisions of Section 30(2) of the Act.”

    The Commission indicated that the removals were effected under Section 30 of the Teachers Service Commission Act, which authorizes the Commission to remove a teacher from the Register following the completion of due disciplinary procedures.

    Legal Effect of Deregistration

    Under Sections 30(4) and 30(5) of the Teachers Service Commission Act, a teacher whose name has been removed from the Register immediately ceases to be recognized as a teacher under Kenyan law from the effective date of deregistration.

    The Act further provides that a deregistered teacher cannot be restored to the Register unless the Teachers Service Commission expressly authorizes the reinstatement.

    The law states:

    “Where the name of any teacher is removed from the register under this Act, such name shall not be reinstated except by direction of the Commission.”

    Consequently, the seven affected individuals are no longer legally permitted to teach in public or private educational institutions unless the Commission subsequently directs that their names be reinstated.

    Requirement for Teacher Registration

    The Teachers Service Commission also cited Section 23(2) of the Teachers Service Commission Act, reiterating that no individual may engage in the teaching service unless they are duly registered by the Commission.

    The Commission further reminded school boards, education administrators, proprietors of private institutions, and other education stakeholders that employing or permitting an unregistered individual to teach constitutes a violation of the law.

    Offences and Penalties

    The Gazette Notice further referenced Regulation 18(1)(c) and 18(1)(d) of the Code of Regulations for Teachers, read together with Section 45 of the Teachers Service Commission Act.

    Under these provisions:

    • An unregistered person commits an offence by teaching or assisting in teaching in any school.
    • A school, institution, or individual also commits an offence if they knowingly employ or permit an unregistered person to teach.

    The Teachers Service Commission noted that persons convicted of contravening these provisions are liable to:

    • A fine of not less than KSh100,000;
    • Imprisonment for a term of up to two years; or
    • Both the fine and imprisonment, as provided under the law.

    The Commission did not disclose the identities of the seven teachers in the statement provided or the specific disciplinary offences that led to their removal from the Register of Teachers. The deregistrations took effect on February 25, 2026, with public notification subsequently issued through the Kenya Gazette dated July 10, 2026.
