School Given Seven Days to Reverse 2026 Fee Increase or Face Court Action.

Parents and guardians at Parklands Baptist School have issued a seven-day ultimatum to the school’s Board of Management (BOM), demanding the withdrawal of a 2026 school fee increase averaging 14.5 per cent or face legal proceedings.

The demand was communicated through a formal letter issued by the parents’ legal representatives on Thursday, July 16. The lawyers stated that failure by the school to comply within the stipulated period would result in court proceedings seeking orders to suspend the revised fees, compel refunds of excess amounts already paid and pursue damages against the school, the Board of Management and its officials.

The demand letter states:

“Should you fail, refuse or neglect to comply within the time stipulated, we have firm instructions to institute proceedings against the School, the BOM and its officers without further reference to you.”

Parents Challenge Legality of Fee Increase

According to the demand letter, Parklands Baptist School implemented revised tuition fees in April 2026 through an average increase of 14.5 per cent across all grade levels.

The parents argue that the revised fee structure was introduced unilaterally without prior consultation, notice or justification, contrary to legal requirements governing school financial decisions.

The revised annual fees are as follows:

Class Level2025 Fees2026 Fees
KindergartenKSh152,500KSh177,500
Lower PrimaryKSh158,500KSh183,000
Upper PrimaryKSh164,500KSh189,000
Grade 7KSh181,500KSh206,000
Grade 8KSh186,500KSh211,500
Grade 9KSh191,500KSh217,000

Board Composition Also Questioned

The parents further contend that the Board of Management was not properly constituted when it approved the revised fee structure.

According to the demand letter, the alleged irregular constitution of the board raises questions regarding the legality and validity of the decision authorising the fee increase.

Legal Provisions Cited

The parents’ legal representatives cite the Basic Education Act, arguing that parents are entitled to be consulted on school financial plans and other matters affecting learners’ welfare before significant financial decisions are implemented.

The demand further alleges that the revised fee structure contravenes provisions of consumer protection legislation as well as constitutional requirements relating to fair, transparent and accountable service delivery.

Demands Presented to the School

The parents have requested that Parklands Baptist School undertake the following actions within seven days:

  • Withdraw the 2026 fee increase in its entirety.
  • Revert temporarily to the 2025 fee structure.
  • Convene fresh consultations involving the Board of Management, the Parents Teachers Association (PTA) and the wider parent body before considering any future fee review.
  • Refund all additional fees already collected under the revised fee structure.
  • Continue providing education to learners whose families have not paid the disputed fee increment.
  • Provide assurances that no parent or learner will face retaliation, discrimination or disruption arising from the dispute.

The lawyers indicate that failure to comply with these demands will result in court proceedings seeking injunctive orders to halt implementation of the revised fees, compel refunds and recover damages against the school, its Board of Management and its officers.

Fee Dispute Follows Similar School Controversy

The dispute arises amid increasing concerns over the cost of living, which has intensified financial pressure on parents meeting school fee obligations.

The matter also follows a recent fee dispute at Alliance Girls’ High School, where the principal faced disciplinary action and the school’s Board of Management was disbanded following an unauthorised fee increase and budget-related concerns.
